Scope
These Terms concern access to and use of the Delta Carrier Group, Inc. website and its content (“Website”). Please review them before using the Website. To the extent permitted by applicable law and where a binding agreement is formed, these Terms govern your Website use. If you do not agree, discontinue that use. Nothing in these Terms excludes rights or obligations that cannot lawfully be excluded.
These Terms are not a broker–carrier agreement, contract of carriage, rate confirmation, bill of lading, owner-operator lease, employment agreement, insurance policy, or other transportation or business contract. Separate applicable agreements and governing law control those relationships. These Terms do not amend them merely because someone visits this Website.
Information, inquiries, and separate agreements
The Website provides general information about Delta and its services, programs, and resources. Sending a message, requesting a quote, submitting an application, or viewing a program description does not by itself create a booking, guarantee equipment or capacity, establish a rate, constitute acceptance of an applicant, or create an employment or owner-operator relationship.
Rates, availability, program eligibility, compensation arrangements, charges, and service obligations must be established through the applicable authorized business process and governing agreement. A Website error or omission does not automatically amend an existing agreement. Where a separate agreement addresses the same subject, that agreement controls to the extent of a conflict, subject to governing law.
Estimates, examples, and program descriptions
Information about revenue, settlements, percentages, costs, mileage, rates, schedules, bonuses, or business results is subject to the stated conditions, the relevant agreement, and applicable law. Examples and individual experiences do not guarantee future earnings, profitability, work volume, or another person's outcome. Gross revenue is not the same as take-home income or profit.
We may update Website descriptions as circumstances change. A Website update does not retroactively change a signed agreement or eliminate earned rights. Contact the appropriate Delta team to verify a material detail before relying on it for a business decision.
Any description of insurance is subject to the actual policy, its limits and exclusions, and the relevant agreement. Website language does not extend coverage or establish a freight-liability limitation.
Tutorials, articles, and shipment information
Tutorials, articles, and other resources provide general information. They do not replace applicable laws, manufacturer instructions, required training, current safety requirements, or instructions governing a particular task. They are not individualized legal, tax, financial, or other professional advice. Do not watch or interact with Website content while driving or operating equipment.
Any shipment status, map, location, or estimated arrival information is informational and may be delayed, incomplete, or affected by communications and location-system limitations. It is not a guarantee of an exact position, arrival time, or service outcome. Use established operational contacts for urgent or safety-sensitive matters.
Access shipment information only when authorized. Do not guess access credentials, bypass controls, disclose protected shipment information, or redistribute a restricted tracking link beyond its authorized purpose.
Permitted use and prohibited misuse
You may use the Website for lawful information and legitimate business inquiries. Delta does not control every aspect of an independently operated service. We aim to provide useful and accurate information but do not guarantee that all Website content is complete, current, error-free, or suitable for every purpose. We may correct errors, update content, or interrupt Website access as reasonably necessary.
To the fullest extent permitted by applicable law, the Website and its informational content are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. These Website disclaimers do not cancel an express obligation in a separate agreement or any warranty, duty, or right that cannot lawfully be disclaimed.
Website-related liability
To the fullest extent permitted by applicable law, Delta will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising solely from use of, or inability to use, this Website, including related lost profits or business opportunities.
This provision concerns Website use only. It does not establish a cargo-loss limit, alter transportation liability, excuse fraud, willful misconduct, or gross negligence, or exclude liability that cannot lawfully be limited. It does not restrict nonwaivable privacy, accessibility, consumer-protection, or other statutory rights.
To the extent legally enforceable, a person who intentionally or unlawfully misuses the Website is responsible for the losses and reasonable costs caused by that misuse, including qualifying third-party claims. This does not require a user to cover losses caused by Delta's own fault or liabilities that cannot legally be shifted.
Governing law, updates, and contact
Subject to applicable federal law and nonwaivable rights, Illinois law governs these Website Terms. Where a forum-selection agreement is legally effective, disputes concerning these Terms will be brought in a state or federal court with appropriate jurisdiction in Illinois. This does not override a separate agreement's dispute procedure or mandatory jurisdiction and does not require arbitration or waive a jury or class proceeding.
We may revise these Terms prospectively and will identify the updated date. Material changes will receive any notice or assent required by law. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion is not by itself a waiver of future enforcement.
